PUWER vs LOLER: What's the Difference for Access Equipment?

People often talk about LOLER when it comes to MEWPs, but there is a second set of regulations that applies too: PUWER. Here's how they differ and why both matter.

PUWER: all work equipment

The Provision and Use of Work Equipment Regulations 1998 (PUWER) cover any equipment used at work – from hand tools to scissor lifts. Under PUWER, equipment must be:

  • suitable for the job it is used for
  • maintained in a safe condition
  • inspected where safety depends on how it is installed or where it can deteriorate
  • used only by people who have had suitable information, instruction and training

LOLER: lifting equipment

LOLER adds extra rules for equipment that lifts loads or people. The key one for MEWP owners is the thorough examination – at least every six months for equipment that lifts people – with a written report.

How they work together

Think of PUWER as the everyday duty – keep the machine maintained, check it before use and make sure operators are trained – and LOLER as the formal, periodic examination of the lifting parts. A scissor lift needs both.

In practice

  • Carry out and record pre-use checks every day the machine is used.
  • Follow the manufacturer's service schedule.
  • Keep the LOLER thorough examination in date.
  • Make sure operators are trained for the category of machine they use.
